Terms & Conditions.

These Terms set out the rules for using the website available at www.medapp.pl (the “Website”), the types and scope of the services provided by electronic means, the conditions on which they are provided, and the complaints procedure.

The service provider and owner of the Website is Medapp S.A., with its registered office in Kraków, ul. Armii Krajowej 25, 30-150 Kraków, entered in the register of entrepreneurs of the National Court Register under KRS number 0000365157, tax ID (NIP): 7010264750, statistical number (REGON): 142641690 (the “Service Provider”). These Terms are made available free of charge on the Website in a form that allows them to be obtained, reproduced and recorded, in accordance with Article 8 of the Polish Act of 18 July 2002 on providing services by electronic means. Using the Website constitutes acceptance of these Terms.

Through the Website, the Service Provider provides the following services free of charge:

• Content access — access to information about the Service Provider, its products and research and development projects, and to investor materials.
• Contact form and e-mail contact — the ability to send an enquiry and receive a reply.
• Newsletter — sending commercial information to the indicated e-mail address, only after prior consent has been given. Consent may be withdrawn at any time, in particular via the unsubscribe link in the message or by writing to biuro@medapp.pl.

The agreement for the content access service is concluded for a definite period and terminates when the User leaves the Website. The agreement for the Newsletter service is concluded for an indefinite period and may be terminated by the User at any time, without giving a reason.

To use the Website you need: a device with internet access, a current version of a web browser supporting JavaScript and cookies and, for services involving contact, an active e-mail account.

The Service Provider notes that using services provided by electronic means carries the risks typical of the internet, in particular malicious software, unauthorised access to data transmitted over the network and phishing attempts. Using up-to-date antivirus software and keeping your browser and operating system updated is recommended.

The User is obliged to use the Website in a manner consistent with the law and good practice, respecting the personal rights and intellectual property rights of third parties. Providing unlawful content is prohibited.

In particular, it is prohibited to take any action that disrupts the operation of the Website, including attempts to gain unauthorised access to its resources, automated content harvesting that places a burden on the infrastructure, and use of the Website to distribute unsolicited commercial information.

The content published on the Website, including texts, graphics, photographs, video materials, layout and design, as well as trade marks (in particular MedApp, CarnaLife and CarnaLife Holo), is legally protected and belongs to the Service Provider or to entities with which the Service Provider has concluded the relevant agreements.

Use of that content beyond permitted personal use — in particular copying, reproducing, distributing or modifying it for commercial purposes — requires the prior written consent of the Service Provider. Quotation is permitted to the extent allowed by press and copyright law, with the source indicated.

The content published on the Website is informational and promotional only. It does not constitute medical advice, a diagnosis or a therapeutic recommendation, and it does not replace consultation with a physician or another qualified healthcare professional.

Information on medical devices is addressed primarily to healthcare professionals, and the availability of particular products and features may differ between markets depending on the clearances in force there. The content of the Website does not constitute an offer within the meaning of Article 66 § 1 of the Polish Civil Code, nor an investment recommendation.

The Service Provider takes care to keep the content of the Website current and accurate, but reserves the right to change, supplement or remove it, and to introduce temporary technical breaks in access to the Website.

Complaints regarding services provided by electronic means may be submitted to biuro@medapp.pl or in writing to the Service Provider's registered address. A complaint should include contact details and a description of the issue.

The Service Provider will consider the complaint and reply within 14 days of receiving it, to the address indicated by the person submitting it.

A User who is a consumer may use out-of-court complaint and redress mechanisms, including the European Commission's online dispute resolution (ODR) platform and the assistance of a district or municipal consumer ombudsman in Poland.

The controller of Users' personal data is the Service Provider. The rules on processing personal data and using cookies are described in detail in the Privacy Policy.

Matters not covered by these Terms are governed by Polish law, in particular the Civil Code, the Act on providing services by electronic means and the Act on copyright and related rights.

The Service Provider reserves the right to amend these Terms for important reasons, in particular changes in the law, in the scope of the services provided or in technical solutions. The amended Terms are published on the Website and apply from the date of publication. Amendments do not affect the acquired rights of Users of the Newsletter service, who will be informed of any change separately.

The Polish version of these Terms is the binding version; the English text is a courtesy translation.
